Market surveillance is a key prerequisite of the EU legislative framework to safeguard that industrial products placed on the European market guarantee high levels of protection for health, safety and the environment. It furthermore should ensure a level playing field for all businesses and economic actors and facilitate preventing distorted competition by producing and placing non-compliant products on the EU Single Market.

Although the exact share cannot be quantified, some applications of Nonroad Mobile Machinery, such as outdoor power equipment, suffer from substantive market shares of non-compliant products on the EU Single Market.

Monitoring and enforcement of compliance with EU harmonisation legislation depends primarily on efficient and effective controls carried out by the national market surveillance authorities of the EU Member States. Key for improving their functioning are:

  • Better coordination among the different Member States authorities;
  • Improved communication with businesses supplying products from outside the EU and the authority of the respective market surveillance authority;
  • Improved tracing and interception of non-compliant products imported from outside the EU;
  • Assigning more resources (manpower, infrastructure, training) allocated for market surveillance.

EUROMOT calls on the European Commission and Member States to facilitate the development and implementation of an ambitious enforcement framework to ensure that legitimate manufacturers that invest into product compliance can continue to operate in a level-playing field.
